"Having found that Respondents are responsible for the unlawful discharge of Hail, they must make him whole for any loss of earnings or other benefits suffered as a result of his removal from the job site. Additionally, in accordance with Thryv, Inc., 372 NLRB No. 22 (2022), the Respondents shall compensate Hail for any other direct or foreseeable pecuniary harms caused by his removal. Back pay shall be computed in accordance with F. W. Woolworth Co., 90 NLRB 289 (1950), with interest at the
rate prescribed in New Horizons, 283 NLRB 1173 (1987), compounded daily as prescribed in Kentucky River Medical Center, 356 NLRB 6 (2010). Respondents shall also be required to expunge from their respective files any and all references to the unlawful discharge and to notify Hail in writing that this
has been done and that the unlawful discharge will not be used against him by Respondents in anyway. The Respondents shall file a report with the Social Security Administration allocating back pay to the appropriate calendar quarters. The Respondents shall also compensate Hail for the adverse tax consequences, if any, of receiving one or more lump-sum back pay awards covering periods longer than 1 year"

 "When the General Counsel called for production of the subpoenaed documents, Counsel for the Council and Local 1977 stated the subpoena was invalid"

 "Counsel for the General Counsel indicated she intended to move to file an amended complaint However, she also indicated she would seek adverse inferences based on that alleged non-compliance with the subpoena, and that she would supply supporting authority and argue those points"

 (2)RETALIATION AGAINST KYLE HAIL FOR FILING AN NLRB CHARGE

The Amended Complaint narrowly alleges that the Southwest Regional Counsel of Carpenters and its affiliated Local 1977, as joint representatives (“Respondents”), violated Sections 8(b)(1)(A)and 8(b)(2) of the Act when it attempted to cause and caused the Employer to remove Hail from the Resorts World Las Vegas construction job site because he filed the (NLRB)charge

 

(3) TARGETED FOR REPORTING LMRDA VIOLATIONS BY HAWK AND SOUTHWEST COUNCIL

"In her post-hearing brief, the General Counsel presents two additional theories. She now alleges Respondents also violated the Act when they attempted to cause and caused Hail’s removal because he: (1) enforced internal
union election notice requirements and declared his intent to run for Local 1977 President against the current slate of candidates; and (2) raised issues with the Council on behalf of other members/employees related to workplace safety and jurisdictional issue"

(4)RULED THE "APPOINTED"EST AND HIS HACK BROTHER WORKED TO HAVE ANOTHER MEMBER FIRED AND VIOLATED THE NLRA

Respondents violated 8(b)(1)(A) and 8(b)(2) of the Act by attempting to cause or causing Hail’s removal from the Resorts World jobsite. Section 8(b)(1)(A) makes it an unfair labor practice for a union to restrain or coerce employees in the exercise of their rights under Section 7 of the Act.

(5)HAWK AND THE SOUTHWEST COUNCIL ENGAGED IN A CONSPIRACY AGAINST ANOTHER UBC MEMBER

I find Respondents’ arguments to be false and fail to rebut the presumption. To begin with,
Respondents’ overall course of conduct does not demonstrate they were acting in good faith to protect the membership as a whole. As discussed, Michael Hawk told Woodruff the Council could not provide Hail’s name or employer, and that Woodruff would need to investigate. But when Hail remained working four days later, Carlton “anonymously”sent Woodruff the texts and recording"
