 "Plaintiff was threatened for filing a workers’ compensation claim and punished for aspiring to be elected or promoted to a council delegate position. Plaintiff was told he’d have the “black knocked out of him.”

      Regarding whether or not the plaintiffs were true victims. The question is irrelevant because if in fact they did act improperly they should have been terminated for cause in compliance with the law, not harassed then terminated. Two wrongs don’t make a right. An employer can’t harass an employee because the employer feels the employee acted improperly.

      The UBC will settle this case as soon as they have to comply with discovery, that’s when these two will be cut a seven figure check drawn from the members wages.

      Management doesn’t care because they don’t have to change their behavior, they keep their jobs, and they don’t pay the bills. Zero accountability. Therefore nothing changes.

      They eat steaks while you and your family go without.

One other thing."then used members money to settle it without the members knowledge" If they were sued and a settlement was agreed to by the lawyers do you think any settlement needed member approval or they had any obligation to tell the members anything.

The just sent a letter to delegates for the upcoming election, which include rank and file members. They state they are union officials and ask for support for No Show Joe.     3. Banfield and his buddies lost our pensions to Madoff. Many upstate NY fund participants pensions were wiped out. McCarron pretended to sue them for $340 million and filed in Federal court . UNITED STATES DISTRICT COURT
      EASTERN DISTRICT OF NEW YORK Case 12-CV-02332. He let them off the hook so fast their lawyers never even had to answer the complaint. Couldn't have his ULLICO pals who carried their policy’s paying. They never filed the terms of the "deal" they made with them with the court.

      To cover for the damage they did. McCarron personally forced the theft of 13% of all members annuity funds and imposed a 25 cents an hour fee for all hours worked. They later stole that money and diverted it elsewhere. There was a vote by the Trustees conducted by McCarron on the 13% and 25 cents and McCarron lost. Decarlo declared it was a UBC rule that if there were more Employer side Trustees than Union side Trustees at the vote the extra employer side Trustees votes did not count making it a tie vote and the UBC wins all ties. McCarron had no right under ERISA to do any of it.
      The UBC tried to file its own lawsuit but they found out the Trustees were advised by Ivey Asset Management to get out of Madoff two years before Madoff broke because something was wrong and the trustees REFUSED because they ere getting 15%. The UBC was forced to jump on a class action withal the other Unions.The lawyers got millions and we did not get shyte

In recent days, several have fessed up to their members their significant exposure to Madoff's investment scheme, which will result in massive losses to their members.

      CNBC has learned that one union, the Carpenters local in Syracuse, N.Y., has lost the majority of the $100 million to $150 million it had in pension money because of its dealings with Madoff, people close to the matter said. The union's money manager, J.P. Jeanneret Associates of Syracuse, didn't return a telephone call for comment.

      The Syracuse carpenters local isn't alone. Pat Morin, business manager of Empire State Carpenters Union, is sifting through the wreckage in his own portfolio, which at the end of June had around $800 million in assets under management. Morin says his fund has exposure to Madoff as well, largely the result of consolidation in union pension funds where locals like Syracuse had transferred money to his oversight

      Technically no one. But anyone can review the LM2 for what that’s worth. The officers of the Local are supposed review and approve all the financial records the LM2 is based on. They are responsible for the content of the LM2.

  46. Our current system has no brake that rank and file members can apply to leadership. We need to be able to vote no confidence in them on a secret ballot. Expecting members to risk their livelihoods to take a stand is not going to happen. Having no representation will also affect how a agent or organizer deals with their superiors. They have no union. How strong ,independent, and principled do you think that system will encourage agents and organizers to be ?

      The loss of the vote to elect our chosen representative eliminated any way that the member could hold his or her own Union accountable for what they did or didn’t do. Something we’ve been suffering from ever since.

Our elected delegates need to wake up and realize that. If they stand together, they have the power to dictate the direction. We need to step away from the Noshow/Mac corporate union agenda. We are not a for profit corporation we are a union. Read what McGuire and the other founders thought our goals should be. We are not moving the ball forward folks.
