WHEN UNIONS(LIKE THE UBC CRIMINAL SYNDICATE) ENTER INTO DUMB CONTRACTS WITH INSURERS(INDEPENDENCE BLUE CROSS) OR PBMS(LEVEL CARE, ACCREDO AND EXPRESS SCRIPTS(CIGNA)) ARGUABLY THEY ARE IN VIOLATION OF ERISA
"Lewandowski’s lawsuit goes to a sensitive spot that had been overlooked until recently: language in the 2021 appropriations bill that revised the 1974 Employee Retirement Income Security Act, known as ERISA.
Her lawsuit is based on congressional language specifying that the law’s requirement of prudent management covers health as well as retirement benefits. By providing workers with a health plan, employers aren’t “doing you a favor. They are holding your money and investing it in your health,”
In July, a similar lawsuit was filed against Wells Fargo, and more suits are in the works.
HOW A DUTY TO SPEND WISELY ON WORKERS BENEFITS COULD LOOSEN PBM'S GRIP ON DRUG PRICES
Lewandowski charges in her lawsuit that by contracting with the PBM Express Scripts, which is part of the insurance giant Cigna, Johnson & Johnson — which fired her in April — failed in its duty to ensure reasonable drug prices for its more than 50,000 U.S. employees.
By choosing an Express Scripts plan, she charged, J&J cost employees “millions of dollars in the form of higher payments for prescription drugs, higher premiums, higher deductibles, higher coinsurance, higher copays, and lower wages or limited wage growth.”
WELLS FARGO SUED OVER EMPLOYEE PRESCRIPTION DRUG COSTS
Wells Fargo PBM Lawsuit: Key Lessons For Employer Fiduciary Responsibility
"The lawsuit states, “fiduciaries cannot discharge their fiduciary duties simply by relying on the advice of third-party service providers, consultants, or experts.” It also states, “Prudent fiduciaries would not hire an employee benefits consultant who was receiving kickbacks or other forms of compensation from the PBM it was assisting in selecting or negotiating with, or who would refuse to solicit bids or accept offers from PBMs who were not paying kickbacks or providing other forms of compensation.”
HEY FRANKIE THE CHIMP SPENCER HOW MUCH DID YOU GET FROM INDEPENDENCE BLUE CROSS
UNITED HEALTH,CVS AND CIGNA STOCK PRICES TAKE ANOTHER HIT AFTER TRUMP SAYS HE'S GOING TO KNOCK OUT THE MIDDLEMAN
“You know the middleman, right?” Trump told reporters Monday. “The horrible middleman that makes more money frankly than the drug companies, and they don’t do anything except they’re a middleman,” he said. “We’re going to knock out the middleman.”
" In comments to reporters, Trump referred to PBMs as “the horrible middleman that makes more money than the drug companies, and they don’t do anything,” according to Bloomberg"

2025 can’t come fast enough. Hope it’s horrible for you Douglas J McCarron inc.
ReplyDeleteI’m sure we’re not getting over charged and under served, Spencer and McCarron have a legacy against such activity!!
ReplyDeleteI doubt at this point any active member is going to sue the UBC or Spencer over yet another skim operation. Retirees have standing as members and are affected by these bad deals that see their insurance costs rise and coverage decline. Retirees could sue and can’t be punished. But I doubt they will either.
Engaged members will have to report and challenge this conduct like Roy Ernst challenged the MUP program here in Philly.
The average working member won’t sue because all they can do is try to survive.
But I know a few members who are compiling a list of those in the 2nd Trump administration to contact to review the long list of criminal acts committed by team McCarron, most of which are already laid out in so many LM2’s and other financial reports.
That could be a good post; who members can contact and how, in the next Trump administration per each type of issue.
01/20/2025…….
I laugh because any former Board Member from the Council gets lifetime health insurance at ZERO costs. Isn’t that ILLEGAL?
ReplyDeleteNERCC successfully sued both drug cos. and Local 24 was party in suing investment guys for costs in one case and results in the second. Of course, this was under previous management in another decade. That was a transformational and inspirational leadership that raised wages, benefits and market share kids.
ReplyDeleteSuccess is within easy reach of those capable of reaching out for it. Team McCarron only reaches into the working members pocket to steal his or her’s money.
DeleteI’m looking forward to 2025 as an opportunity to hopefully see a new administration hold Team McCarron accountable.
