This lawsuit arises from a corrupt investigation by the DC’s Office of the Inspector
General (“OIG”), wrongly instigated by Geiger in retaliation for plaintiff exercising his union
freedom of speech rights in opposition to a Geiger business proposal, which was contrary to the broad interests of the union members.




 "Geiger and his cronies withheld evidence, including video and audio recordings and sworn witness statements"



"OIG investigator interviews were shown to be corrupt, including falsifying
witness statements
"Burroughs was provided with further evidence that the crony
OIG investigators were unqualified and corrupt, some of whom were engaging in massive self dealing
in complete violation of consent decree and DC rules



During 2016-2017, McGorty undertook a review of OIG. The end result was
merely Danielson’s resignation.

"Not withstanding that it was known that several OIG investigators lacked qualifying investigative backgrounds, were appointed through cronyism, had engaged in years of corrupt, self-dealing conduct and other conduct in clear violation of DC bylaws and rules, McGorty informed the supervising United States District Court Judge that all was well".



15. In violation of the federal consent order DC officers, including Geiger and
supervisory and administrative employees, regularly referred non-OWL union workers to jobs.



170. Plaintiff is not required to exhaust his remedies with the UBC because: (1) it was
fully aware of all of the DC’s conduct and the subsequent investigation, and was complicit
through its silence;


195. "Without justification and solely with the intent to harm plaintiff, Geiger had

    This is what is happening here in Philadelphia. Hand job and Hacker are controlling dispatching Carpenters to posh jobs. Only suck-ass cronies have access to good or any jobs . Meanwhile the rest of the members have to fend for themselves.

    The phila delegates that have not been elected going on 8 years sold out for golf, fruit cups, and shrimp cocktails.
    All one needs to do is look at a group photo of our " representatives" to see what the problem is. Its about 80 to 100 lbs on avg ....when you can no longer bend over you find a new way to bend over.

    9. Why are you afraid to list it with the IRS?

    Show us the vote on these " by law" changes in which individual members voted or had input on.

    Selected appointed delegates making decisions and " voting" ( rubberstamping) decisions is against our charter and by laws.

    It is now time for every member to notify the IRS in mike hands name, a complete forensic audit of all of our funds... The leadership assets personal and their family and friends.

    This IS NOT LEGAL if the UBC continues to receive
    " not for profit"
    " tax exempt status"

    Nrcc had it bc it was the new and improved version of the " pickett dues" that spencer and sproules and eustace egge and dennis garbowski and many other stews, agents, and organizers used to use to supplement their incomes.
    For you younger carpenters. We used to get shaken down for cash by the aforementioned.

    So since 2006 nrcc was extorting their members to the tune of 250 a pop.

    Where is that fund?
    Where is it listed?

    Then in 2015 with the illegal hostile take over of the philadelphia " bank"
    They hit us with mups... Illegally took dues for 3 years until our mrc contract expired on may 1st 2018.

    Think about that. The NRCC without authorization to do so... Unless you specifically signed the mix 20 20 sheet which was a trick to get you to sign... The nrcc stole money from your paycheck and had the balls to levy a 500 a year dues assessment on you... Without your consent.

    Ever wonder why charlie brock always shut down questions?
    He and Hand and alll of them KNOWINGLY stole from you and their sole purpose was to kick it down the road just long enough for our contract to expire. Then we were illegally absorbed by the nrcc because by charter and constitution we should have been afforded the right to vote if we wanted to be part of the new council.
    They knew this. It was alll illegal. Every move.

      The Feds are as bad as the UBC, utterly useless. Now I will say that in general the Feds don’t investigate crimes not brought to their attention by someone; a citizen, an employee, who ever. But the DOL was definitely asleep at the switch, they should have audited the UBC and the regional Councils after the latest mergers!!!! The MUP program funds???? They should have been all over that irregularity and many others such as the credit cards!!! How much does the Council spend on employee expenses via credit cards??? Are these expenditures in the best interest of the members??? You know that figure is in the tens of thousands of dollars per MONTH!!! That alone should merit further review!!

      Keep in mind the FBI protected guys like Whitey Bulger for thirty 30 years!!! Did they eventually turn on him? Yes. But what did it take?? About 30 years..... Who has been President of the UBC for almost 30 years??? Douglas, is your time almost up???

    This Union is no different then the Fortune 500 companies that span our companies. Our leadership has been able to grow our fund and their accounts of our backs and they’ve been able to do it by systematically stripping away our rights as Union members and giving our power to their appointed representation that doesn’t have any of the daily struggles that we have out in the field. They can all say they’re one of us but we know they’re towing the line and can’t really fault them because they’re making a lot of money to be Road Cones and watch the traffic go by. Huge profits are made yearly off of them playing with our money without the slightest trickle down to the members. That’s a free tip for any of our leadership that reads this site, you wouldn’t have people trying to take you down if you shared the profits made off the the hard work of the men and women that drive this organization. Leadership brings nothing to the table. We were out in the field fighting for jurisdiction, calling in jobs and standing up for job standards. What has leadership done? Merged councils, appointed their own delegates, given more freedom to the contractors and killed off what little participation you had left. Union meetings are empty, I’d be embarrassed if I was in charge of a consolidated local and I wasn’t even getting 10% to show up to a meeting but that’s just me. A carpenter that can’t see past his paycheck is the perfect Union man now because a member with a voice is a fly in the ointment. The voices need to rise up we’re losing this battle, market shares are going backwards and bodies per job is going way up with these mergers. Our handpicked leadership is powerless to provide any oversight into if area guys work or not anymore. It doesn’t matter what part of the country your in, we have members losing work to out of towners and it doesn’t matter because someone is paying into the fund. We’re losing on all fronts and we need to come together before it’s to late because nothing last forever.

      Now does it make sense why a pac from carpenters southwest region would send over 500k to new jersey. A blue state. That reallly doesnt need a ton of monies to elect dems.

    To the interested member, PUT YOUR SLATE TOGETHER FOR THE UBC CONVENTION DELEGATE ELECTION! The establishment is counting on the fact most members are afraid to run or do not know how to run an election campaign. The election process in not rocket science. Put your slate together. Your nominated delegates must be willing to work together as a team, and willing to stand up and challenge McCarron’s slate of IDIOTS!

    Build a coalition of like members to recruit supporters for your slate's nominations, and for your slate's elections, as delegates to the UBC Convention. In most Locals, the nominations and elections for convention delegates takes place on the same day. Your slate and your supporting members must be a large enough group to overpower your Local’s worthless establishment leaders. The power within our Union is with the working-class tradesmen, acting in collective spirit. The hand-picked McCarron morons will not know what to do!

    Every Local receive the UBC Convention Call. Each Local must report at their monthly Union meeting (during Local Union communications), the UBC Convention Call.

    Each Local must announce to their respective memberships (through the mail) the times and date(s) for both the nominations and the elections of delegates for the 2020 UBC Convention.

    UBC Locals can not deviate from this process. Any deviation from announcing the UBC Convention Call, to the membership, is a violation within the LMRDA.

    Members who are not aware of the Convention Call must contact their Locals. Ask your Local if there was a Convention Call mailer. Ask your Local if the UBC Convention Call was announced at the monthly meeting . . . and ask your Local for a copy of the Local's monthly meeting minutes, which memorizes the UBC Convention Call announcement. Ask your Local if they have mailed the announcement of the time and date of the UBC Convention Delegate nominations and elections. To those members who are not aware of the UBC Convention Call . . . spread the word!

      This is why there are soooo many references to the fact that the ubc can NOT enjoy " not for profit" , and " tax exempt" status ... Since they are operating outside of federal law. Not a guideline. Law.
      This is why not only lmdra, but IRS needs to get involved.
      Local 158. The largest, is the biggest violater of this.
      There needs to be a mailing to every single member to their last known address. Not e mails.
      Not everyone has an email.

      They are allllll tooo prompt when they mail you a mups letter!!! Dont tell me they cant mail the convention call to EVERY MEMBER. Bullshit.
      They are purposefully trying to keep the membership from participating in their rights as members.... But have noooo problem finding you for a forced mups.

    John Ballantyne did the right thing by firing George Laufenberg, Then Laufenberg is indicted by the feds on criminal charges, Ballantyne then gets Reprimanded by Spencer and Capelli for firing George Laufenberg. Then John Ballantine gets taken out by McCarran through a so-called merger! John Ballantyne, I think the timing is right, transparency is what is needed in this brotherhood and integrity is what is needed in this brotherhood. His split with team McCarron is all about them trying to make him the fall guy for their criminal enterprises and he drew the line at that point!!! Is this heroic?? No, it’s self preservation. That aside will I support Ballantine if he runs at the UBC GC??? Absolutely!!! But my support is based on reimpowering the members not just changing the name of our UBC President. If I can earn a pay check working in the field building bridges than I can chose who represents me!!! I’m not paying dues to be represented by the likes of Billy Sproule to the tune of over $300,000 plus a year. I’m not paying Reps to enjoy benefits that I pay for that I don’t receive such as vacation or sick time!!!     At least you can count on Ballantyne to not extort their own employees and delegate bodies. I’ve come to find out on good authority that McCarron has already started collecting funds for his campaign we are keeping lists of all the delegates that donate to him to the tune of $100 for staff members who are delegates and a slight break for non-staff. He has individual’s Being asked by their boss on work hours. Not only creating awkward situations for the employee employer relation but making it seem as if you didn’t donate it would be noticed. This tactic is straight up strong arming, and is completely against against how one is supposed to campaign outlined by law. This union is crumbling from the inside out. Any choice rather than McCarron Would be the best choice possible for our Union. At least in Ballantyne would turn around and finish cleaning house, A process that he had started well before they decided to get rid of them it just got too close to home for them.

    To expect mccarron to follow ANYTHING in the ubc constitution is laughable.
    He will just " change" it to suit his needs. Just as he has for every gc. This IS the whole problem.
    Mccarron created by having a coerced, intimidated, blackmailed, autonomy to be in essence a dictator.
    The ubc constitution is a piece of shit.
    We are a fortune 500 company with a ceo who does as he pleases.
    So. We out the union.

    Force them to declare and pick the model they are.
    You cant be both.

    The back tax burden will implode mccarron when he tries to shift the penalties onto the members.

    Tax exempt status. Gone.
    Not for profit status. Gone.

    You can not be both.
    You are either a union under federal law, or you are a fortune 500 company.....again... You cant be both.
    There is soooooo much corruption and violation of federal law... Its alll coming to a head.

      A fake Union is far worse than a corporation, because corporate share holders have far more rights and protections under the law then we do as members of a fake Union. Positive change would be awesome, I just don’t think it’s possible at this point. As we all know, most of the Delegates at the UBC GC will be Council Reps Abe those Reps are not voting for anyone but McCarron and Co. because they rightly fear new leadership would put them out of a job. This is the dictatorship that we work under now and collapse is probably the only reasonable outcome. But the Feds will help us won’t they??? Not at all. They’ll just move and charge us a high price for compliance that will kill what’s left of the UBC. Well done Doug you ruined an entire Union.

    Question: Who should one submit a request for council employee credit card statements too?? I guess that would go to the current EST? Next question: Who should one Carbon Copy on that request? Bill Waterkotte, Mike Capelli Frank Spencer, and Eugene Scalia?? Maybe it would be best just to request a list of those who have been issued a credit card provided by the UBC, the Eastern District, and EAS Council and then request a copy of ALL the statements associated with each credit card?? You know could help?? Maybe the trustees of the UBC, the Eastern District, and the EAS Council?? What do you think trustees? I hope the timing of this request is not too inconvenient before the GC??

      They had council officer elections without any notification to members... By design... So how could you know.
      The transparency is soooo see through its almost opaque.
      Bullshit.
      Now that we are EAS god only knows who it is.
      This is by design.

      It is time to eliminate council reps and officers from holding 2 and 3 positions. It is a complete effort to stifle any member input.
      They are at will employees and can NOT advocate for the member as many of them ARENT even under the cba?
      See a conflict here?

      We are not a union.
      We are the elites who were chosen because of lack of integrity ... Feasting off the labor of all of you who earn it.
      It is time to either be forthright that we arent a union and dissolve... Or take back the union from these scumbags who stole and are stealing your livlihood and giving it away while stuffing their pockets with your retirement funds.
