CARPENTERS UNION AGAIN SUES FORMER ST.LOUIS LABOR LEADER

ST. LOUIS — The Mid-America Carpenters Regional Council is accusing former St. Louis union leader Al Bond of breaching his fiduciary duty to the union in a new lawsuit filed this week in St. Louis Circuit Court.

The new legal action against Bond comes after a U.S. District Court judge in March dismissed the union’s federal lawsuit against Bond on procedural grounds, ruling only union members and not unions themselves could bring actions against leaders using the 1959 Labor-Management Reporting and Disclosure Act. A union lawyer said then it planned to pursue its legal claims in state court.

Bond led the St. Louis-Kansas City Carpenters Regional Council from 2015 until September 2021, when he was ousted without explanation by national leaders at the United Brotherhood of Carpenters. The 22,000-member St. Louis-based council was an important force in area development projects and held considerable sway in regional politics, funding candidates and putting its weight behind major efforts such as an ill-fated attempt to privatize the city-owned airport and the Better Together-led city-county merger campaign.

Though the union was mum on its reasons, court filings and other documents eventually disclosed that union leaders were investigating “financial impropriety” by Bond. It dissolved the St. Louis council and put its operations under the Chicago district council, which was renamed the Mid-America Carpenters Regional Council.

The new lawsuit makes many of the same claims against Bond as the federal lawsuit filed in March 2022. It accuses Bond of using union funds to pay $900 of his daughter’s medical bills, buy a $1,300 CPAP machine used for himself and purchase Fox Theater season tickets worth $4,500 between 2018 and 2020. It also alleges he had the union pay him nearly $18,000 for an unauthorized, retroactive salary increase.

 It also contains one new allegation, accusing Bond of spending $5.6 million to buy land and build and furnish a new wellness center in Kansas City without proper approval from the U.S. Department of Labor. Because the land had been owned by the affiliated Carpenters Joint Training Fund, the lawsuit says, the St. Louis council needed a waiver from the Labor Department.

 

But while the waiver application was pending, Bond ordered construction to begin despite the union’s attorney advising him to wait, the lawsuit alleges. That caused the Labor Department to deny the waiver, imposing additional application costs on the union.

In addition, the lawsuit says, Mid-America “will be fined and civil penalties will be assessed by the DOL at an amount yet to be determined.”

Bond has not yet filed responses in the case, but his filings in the federal case called the national union’s dissolution of the St. Louis council “a political coup d’etat” and “a hostile takeover.” Bond’s attorney, longtime labor lawyer John Goffstein, declined to comment on the new lawsuit. A lawyer for Mid-America, Philip Cantwell of Dowd Bennett, declined to comment.

The lawsuit is one of several filed since Bond’s ouster.

 Mid-America last year sued two billboard companies owned by James Neumann over a $4 million contract outdoor advertising contract Bond approved. The union alleged Bond, who it said has “a close personal relationship” with Neumann, paid the companies $3 million before seeking board approval and that only one of three billboards was actually built. After a judge tossed the federal lawsuit, the billboard companies filed their own lawsuit in St. Louis, and the union countersued last month.

Last week, Mid-America sued developer Paul McKee and companies tied to him over $1.8 million due on a 2020 union loan Bond approved to support the operations of the largely defunct Green Leaf Market grocery store.

 FORMER LABOR LEADER JOHNNY DOC FOUND GUILTY OF 70 COUNTS OF FRAUD AND EMBEZZLEMENT

After a trial that lasted six weeks, a jury convicted Dougherty of most charges related to funds he stole from the union he once led.

A jury has found former Philadelphia labor leader John “Johnny Doc” Dougherty guilty on 70 counts of embezzling funds from the electricians union he once led. This marks his second conviction on federal charges in about two years, making it more likely he will serve prison time.

Following a six-week trial, Dougherty was convicted of the vast majority of charges against him including embezzlement, conspiracy, wire fraud, tax fraud, and falsifying financial reports.

Once a hugely influential political force who directed millions in contributions to local, state, and national political campaigns, and helped elect Mayor Jim Kenney and other officials, the 63-year-old Dougherty used hundreds of thousands of dollars of funds from Local 98 of the International Brotherhood of Electrical Workers (IBEW) to fund a wide variety of personal expenses, prosecutors said.

Dougherty’s codefendant, former union president Brian Burrows, was also found guilty of conspiracy and other related charges. Four other former union employees previously pleaded guilty in the case. 

 

Together they spent more than $600,000 from union accounts on groceries, expensive restaurant meals, home repairs, music and sports tickets, and other personal spending. According to a lengthy and blistering indictment handed down in January 2019, Dougherty’s family members and others, were beneficiaries of the ill-gotten largess.

Dougherty was convicted in November 2021 on  federal corruption charges for bribing his co defendant in that case, former City Councilmember Bobby Henon. Henon reported to prison in April 2023 to serve a three-and-a-half year term, while Dougherty’s sentencing was postponed until all the charges against him are resolved.

He still faces a possible third trial on extortion charges.

 Prosecutors allege ‘intentional theft’

Among the spending that directly benefited Dougherty was more than $40,000 in contracting services at his Pennsport home, including a $4,200 large-screen TV installed in March 2014, the Inquirer reported. There were $7,000 in gift cards to Boyd’s clothing store, $2,600 in clothing from Brooks Brothers, and $1,100 in tips at Phillies games in 2015.

Union contractors performed  plumbing work in a former pub two members ran in a Pennsport building owned by Dougherty, and the union leader paid for snow removal and painting work at the home of his brother, state Supreme Court Justice Kevin Dougherty, per the indictment. Kevin Dougherty was not charged or accused of any wrongdoing.

Local 98 also paid for work on homes owned by the union’s boss’s daughter and sister.

Lucky Charms cereal, frozen pizza, potato salad and soup from Famous 4th Street deli, frappuccinos, processed cheese spray, and Del Frisco’s lemon cake, were among many delicacies Doughtery paid for, as listed in the indictment. 

 

Dougherty bought seven honey-baked hams and sides to give as gifts, describing the purchase as “Toys and Turkeys (for food baskets)” on a reimbursement form.

During the trial prosecutors described the spending as “intentional theft,” while Dougherty’s attorneys argued he didn’t know about many of the purchases, or mistakenly charged them to Local 98 because he was very busy and distracted by his work for the union, the Inquirer reported.

Defense attorneys for Dougherty and Burrows attacked key witness like contractor Anthony Massa, who they alleged was lying on the witness stand in exchange for leniency from prosecutors.

They also tried to have the case thrown out over the FBI’s use of secret recordings of Dougherty made by an informant, which they argued compromised the union’s right to a fair trial. Judge Jeffrey Schmehl, who presided over both trials, rejected the argument.

One  recording is  of a November 2019 meeting where Dougherty urged any Local 98 members who might consider betraying him to kill themselves, per the Inquirer.

“I’m going to make sure everybody, everywhere — everybody at your kids’ school — knows that you’re a punk and a rat and a creep,” Dougherty said on the tape. “Your kids don’t want to grow up knowing your daddy’s a rat, daddy’s a punk!” 

 A potential third trial

The former union boss could face up to 20 years for the corruption conviction alone, although he may receive much less time given the relatively short term handed down to Henon, according to Michael Levy,, a retired former federal prosecutor who teaches at the University of Pennsylvania law school.

The seriousness of the extortion charges, which include allegations of violence by Dougherty’s nephew Gregory Fiocca, mean the “odds [are] decent” the former union leader will go to jail, Levy told WHYY’s Billy Penn in October.

The indictment says Fiocca failed to show up for his job as a Local 98 shop steward at a job site, and when he wasn’t paid for the hours he was absent, assaulted a company manager. After Dougherty threatened to pull electricians off the job and prevent the company from getting future projects, Fiocca continued to get paid despite doing little work, prosecutors say.

The government offered to drop the charges against Dougherty if he pleaded guilty to an embezzlement count and served a short prison term, the Inquirer reported. He refused the offer.

When a sentencing hearing is held, defense lawyers may present mitigating information in an effort to convince Schmehl to give Dougherty a short sentence or no jail time. Dougherty can also appeal his convictions after he’s sentenced, which would launch another lengthy legal process and could keep him out of federal custody for years

Last night we finally got a look at the finances of “Jersey Freedom,” the independent expenditure committee that disclosed its existence late in the campaign with mailers and TV ads boosting “conservative” alleged phantom candidates and an unwitting Libertarian candidate to siphon votes from actual Republican candidates in two South Jersey districts.

According to its latest report from ELEC, Jersey Freedom raised $225,000 — all from Brighter Future Forward, a South Jersey Democratic super PAC that also first came to the public’s attention late in the campaign season. The money came in two installments on Oct. 26 and Nov. 1. Brighter Future Forward’s funding, in turn, came exclusively from two sources: $2.5 million from Carpenters union-affiliated super PACs in two installments over the summer, and $1.165 million from American Representative Majority, the long-existing South Jersey Democratic PAC, in payments made on Oct. 26, Oct. 30 and Nov. 1.

The biggest source of income for American Representative Majority was Democratic power broker George Norcross, who loaned it $850,000 on Oct. 25 and $500,000 on Oct. 30. That $1.35 million from Norcross is just over half of everything the group reported raising this election cycle.

It was pretty obvious based on circumstantial evidence that Jersey Freedom was a South Jersey Democratic venture. Now it’s official. Jersey Freedom — whose bank account was frozen by a judge after Republicans filed suit — also released a statement shortly after filing its disclosure form with ELEC, though no one put their name on it. It says the group fully complied with the law in disclosing its existence in October and only disclosing its funding source 20 days after the election. .

“Jersey Freedom has fully complied with the recently enacted Elections Transparency Act, authored by Senator Nick Scutari and signed into law by Governor Phil Murphy on April 3, 2023.,” reads the beginning of the statement.

Wait a second. If that’s the case, does this mean the Elections Transparency Act didn’t actually make elections more transparent?

But stories about Norcross’s bare-knuckle tactics occasionally leak out most famously in the recordings known as the Palmyra Tapes. Because they know we put up the gun and we pulled the trigger and we blew their brains out.” And he makes clear what he has done to men who have crossed him: “I sat him down … and said, ‘Herb, don’t f..k with me on this one … ’cause I’ll tell you if you ever do that and I catch you one more time doing it, you’re gonna get your f...ing b...s cut off.’”

 The group was funded entirely by Brighter Future Forward, another political committee allied with South Jersey Democrats.  That group was funded by the Carpenters Union and another one of their organizations, American Representative Majority, which received a $1.9 million loan from Democratic powerbroker George Norcross.
