Despite Douglas McCarrons declaration that a UBC member can hold office unless collecting an “International Pension” the Department of Labor has ruled THAT IS FALSE and he as well as others are holding office in violation of the LMRDA and the UBC Constitution. The US DOL has rightfully ruled that the receipt of any carpenters' union pension within the jurisdiction of the UBC disqualifies a carpenters' union member to be eligible to be elected or appointed as a carpenters' union officer, delegate, or committee member.

The investigation revealed that the Constitution and Bylaws at Section 31(D) provides that a member cannot hold office or a position on a committee if drawing from a Carpenter’s pension plan. "The Department found that two members of the Election Committee were retirees drawing from the Local’s pension plan. The Department’s investigation revealed that the presence of the retirees on the Election Committee was a violation of the Carpenter’s Constitution and thereby a technical violation of the Act," see 29 C.F.R. §§ 452.2 and 452.109.

Section 42 (I) of the UBC Constitution

(I) No member of the United Brotherhood can remain in or become

a member of more than one Local Union, or any other organization

of carpenters and joiners, or any mixed union of building trades

workers, or any organization whose jurisdictional claims overlap

or infringe upon those of the United Brotherhood, under penalty of

expulsion. Any member who accepts employment under nonunion

conditions during the time of a strike or lockout, or being employed

as an armed guard during a strike or lockout, shall not be entitled to

any donations. If a member is accused of holding membership contrary

to this Section, the Executive Committee of the Local Union

or District, Industrial or Regional Council shall give the member

due notice of the charge, shall afford the accused a hearing and a

full opportunity to present a defense. If after hearing the Executive

Committee finds that the member holds membership contrary to

this Section, the member shall be permitted thirty days in which

to resign or withdraw from any conflicting membership and to so

notify the Executive Committee. If the member fails to do so, his or

her membership shall be revoked.

It was rather surprising when we learned of the Phylis Borzi connection to the NCCMP. We were shocked when w learned that since 2008 Brozi has been parading all over the world with the NCCMP conspiring to create changes to ERISA law that would allow the theft from Retirees.

Borzi has presented these NCCMP rats and has declared them “high level decision-making authorities” representing the US . They are the people responsible for diverting billions of pension dollars into scams such as ULLICO and responsible for our funds suffering huge losses such as the First Trade Union Bank or ULLICO s entire Casualty Insurance division wiped out. What they are not is“high level decision-making authorities” representing the US. We still have not been given answers as to what Borzi was doing with them. Who paid for all these trips. Who paid for Borzis end. We have not had answers as to why they have allowed these huge diversion of multi employer fund money into companies like ULLICO who have been hemorrhaging money for years despite their fiduciary duties to our funds. We are also amazed and shocked at the absurdity of Kline holding hearings just for these NCCMP Rats as we learned of the danger retirees still face because it appears the rats are not done yet and have more theft planned for our workers and retirees.

      Even with retires reeling from the shock of the theft of their pension checks Even as the Teamsters are bracing for the tanking of their fund by a little weasel rat like NyHan who it is clear has no remorse ,no regret or sympathy for the Central States funds retirees he so gleefully wants to tank. Even as Retirees pan a defense against this we have been warned of yet another scam in the works by these Carpetbaggers,. The plans are already in motion of their infrastructure scam. This scam will be financed by the Pensions as well.. ULLICO rolled out yet another scam fund called the Infrastructure Fund in 2012 and behind everybody’s back crawled in bed with China. They are now are in NYC making loans with the Bank of China to developers as part of their scam to control the non Union by loaning them members money and financing it with Pension fund money. They are now not only stealing from funds but from retirees themselves.. Four International Presidents have created the National Infrastructure Alliance which is again funded by Union members money. The Laborers Terry OSullivan, The Carpenters Doug McCarron, The Operating Engineers Callahan and the Iron Workers Walter Wise.

  As predicted the media propaganda campaign has begun just as predicted with these Carpetbaggers wringing their hands and expressing great worry and concern for the conditions of the American Infrastructure as if they really could care less. Now they have moved to the next stage where for a small cut of the action they will come up with the money from their new friends in the Chinese and Japanese Banking Industry with the Bank of China ,the Development Bank of Japan and  Mitsubishi UFJ Financial Group already on board (Ill let others help you understand the ramifications of the Banks of China and Japan financing the infrastructure of this country. )and from the US end more money they will divert, demand and steal from American Pensioners. Sen. Bernie Sanders and Rep. Marcy Kaptur Act to Stop Devastating Cuts to Retirees' Pensions

WASHINGTON – The Pension Rights Center strongly praised Senator Bernie Sanders (I-Vt.) and Representative Marcy Kaptur (D-Ohio) for introducing legislation today that would repeal the pension cutback provisions of the Multiemployer Pension Reform Act of 2014 (MPRA). The Keep Our Pension Promises Act of 2015 would preserve retirees’ pensions while providing financial relief to troubled multiemployer pension plans, their contributing employers, and the federal pension insurance program, the Pension Benefit Guaranty Corporation. Unless repealed, the pension cuts authorized by MPRA will be devastating to the financial security of hundreds of thousands of retirees in certain underfunded multiemployer plans. 
“By introducing the Keep Our Pension Promises Act, Senator Sanders and Representative Kaptur are taking action to right an injustice that threatens the financial wellbeing of hundreds of thousands of retirees,” said Karen Friedman, executive vice president and policy director for the Pension Rights Center. “We want to thank Senator Sanders, Congresswoman Kaptur, and the legislation's co-sponsors for recognizing how unfair the pension cutback provisions of MPRA are and for championing their repeal.”  Initial co-sponsors include Senator Sherrod Brown (D-Ohio), Senator Tammy Baldwin (D-Wisc.), Representative Brendan Boyle (D-Penn.), Representative Tim Ryan (D-Ohio), and Representative Jan Schakowsky (D-Ill.).
Last December, during the waning hours of the 113th Congress, MPRA was rushed through Congress as part of the must-pass “cromnibus” spending bill. Buried in the legislation were provisions that allow trustees of severely underfunded multiemployer pension plans to make unprecedented cuts to retiree benefits, overturning 40 years of pension protections. Members of Congress and the public were not given time to examine these stealth provisions or to debate them. Efforts to get those provisions removed from the spending bill were unsuccessful in the face of an imminent government shutdown.
Since MPRA’s passage, retiree groups around the country have repeatedly called for the cutback provisions to be repealed. More than 100 retirees whose pensions could be cut attended today’s event introducing the Keep Our Pension Promises Act.
Frank Bryant, a retiree from North Carolina, spoke at the press conference. “I am 74 years old. I drove a truck for UPS for 31 years and retired in 2003,” said Bryant. “It was back-breaking work. By the end of my career, I think I put in over a million hours of driving in snow, sleet, fog, morning to night, in every condition. What kept me going was knowing that, at the end of my time, I was going to get a pension that was going to allow me to live comfortably in my retirement. If these cuts are allowed to go through, a lot of retirees’ lives will be ruined.” 
Retirees came to Washington from Minnesota, Nebraska, New York, North Carolina, Ohio, Pennsylvania, and Wisconsin to show their support of the bill. “This is only the beginning,” said Bryant. “We are going to expand this movement to other unions, and other retirees, and get the retiree cuts stopped.”

THE TRAINING FUND WAS NOT TO BE INVESTIGATED AND ONLY NOTIFIED OF A PENDING ROUTINE AUDIT WHICH HAD NOT EVEN STARTED YET.DESPITE THIS TRUTH IN THE WEEKS LEADING UP TO THE 14D TRIAL THE UBC AND PHIL NEWKIRK HAD CREATED AND SENT OUT A LETTER SAYING AN INVESTIGATION HAD TAKEN PLACE.IT WAS ONGOING AND IT HAD FOUND MIKE MCCARRON GUILTY OF ALL THE THINGS THE UBC AND MIKE DRAPER HAD ACCUSED HIM OF .THE FACT WAS THAT THE TRAINING FUND AUDIT HAD NOT EVEN BEGUN AND THE ONLY DOL INVOLVEMENT WITH THE SWRCC AT THAT TIME WAS TO RULE THAT THE TRUSTEESHIP OF THE SWRCC COULD CONTINUE BECAUSE THE UBC HAD FILED ALL THE CORRECT PAPER WORK. THE DOL LETTER MADE A POINT TO DECLARE THAT "IT WAS NOT COMMENTING ON AND HAD NOT INVESTIGATED THE LEGALITY OF THE ORIGINAL TRUSTEESHIP". SO WHAT INVESTIGATOR DID I VOLUNTEER THIS “OPINION”THAT THE BONUS I WAS GIVEN WAS ILLEGAL OR IMPROPER TO. NAME THE DOL INVESTIGATOR WHO TOOK MY STATEMENT. IF NO FEDERAL,STATE OR UBC ENTITY, WITH THE EXCEPTION OF DECARLO AND SHANLEY, HAS DECLARED MY BONUS IMPROPER OR ILLEGAL WHY WOULD I VOLUNTEER ANY SUCH STATEMENT TO THE  DOL WHO WAS NOT PRESENT AND NOT INVESTIGATING THE TRAINING FUND AS YOU ARE BEING FALSELY ADVISED...
