  Walsh Begins New Phase Of Investigation Into Mob Influence Over District Council

 

In December Review Officer (“RO”) Dennis Walsh, issued his First Interim Report, which was filed in federal court in Manhattan, accompanied by hundreds of pages of exhibits, and included evidence and troubling allegations that the council remains influenced by the mob and is still a source of cash and illicit benefits for a select few.
“My office has deep historical knowledge and is developing current information about actual and attempted influence of organized crime over the affairs of the district council and the funds,” the RO, wrote in the report. “We have developed sufficient information to reasonably suspect that there are certain district council employees who have been and are currently under the influence of La Cosa Nostra figures.”
The report said individuals involved in running some of the local unions were under scrutiny for similar ties, something that Walsh said was “a matter of grave import” that remained under investigation.
In an email, the RO said he has begun a new phase of investigation pertaining to organized crime influence over the affairs of the District Council, its affiliated local unions and members. As part of the investigation, employees of the District Council are asked to disclose any information that they have about such conduct other than what they may know from the information available from the docketed materials in U.S. v. District Council (90 Civ. 5722) or from media accounts.
Those who say that they have no such information are asked to confirm their response by signing a declaration under penalty of perjury pursuant to Paragraph 5.d of the Stipulation and Order entered on June 3, 2010 (which grants the RO the authority, among other things, to compel sworn statements of any officer, agent, representative, employee, trustee or member of the District Council or the Benefit Funds concerning any matter within the RO’s authority).
All such persons are given a reasonable opportunity to consider their options and to consult with an attorney and may invoke their privilege against self-incrimination. All such persons are required to cooperate with the RO in this undertaking pursuant to Paragraph 7 of the Stipulation and Order. Failure to comply with the undertaking or invocation of the right against self-incrimination may subject persons to action pursuant to Paragraph 7, which makes failure to cooperate an express violation of the Stipulation and Order, as well as Paragraphs 5.b and 5.f.
The investigation is broad in scope and many employees (as well as persons affiliated with the Benefit Funds) can expect to be interviewed in the near future.

Sources say Brugueras is the third person to resign because he refused to sign an affidavit from the Review Officer, Dennis Walsh, stating he's not connected to or has any knowledge of organized crime influence over the district council. Richard Tuccillo and Paul Pietropaolo also resigned and did not sign the affidavit. 

Brugeras was Director Eddie McWilliams, deputy in Organizing and hired last year at the request of Joe Olivieri, an informed source said.

The Eastern Atlantic States Regional Council of Carpenters plans to relocate its headquarters and two local training centers to the Philadelphia Navy Yard.

“We’re extremely excited about the prospects and what this facility is going to transform into over the next few years,” William Sproule, executive secretary-treasurer for the Carpenters, said on Tuesday. “It’s really only the beginning of the story, and we’re going to be doing a lot of neat things down there.”

The council had outgrown its Spring Garden Street facility, Sproule said, and started seeking a new property 2½ years ago. Philadelphia buildings continue to have vacancies as a result of the pandemic, he said, and the current state of the real estate industry represented an opportunity.

The council purchased the Navy Yard building for $52.5 million, said Sproule, and the deal closed on Dec. 19. The building at 5 Crescent Dr. previously sold for $130.5 million in 2018.

The four-story, 208,000-square-foot building was designed for drugmaker GSK by the architectural firm of Robert A.M. Stern, which is also responsible for the first Comcast tower.

The pharmaceutical company moved its operations to the Navy Yard from Center City in 2013.

Although GSK was a remote-friendly company since before the COVID-19 pandemic, the building remained well used until 2020.

Then, in 2022, GSK moved its operations out of the then-lightly used Navy Yard office to a 50,000-square-foot office in University City’s FMC Tower. In an unusual move the company continued to pay rent at the former location, and did not seek to sublease the space.

That left the building at 5 Crescent Dr. in a tricky position: it is difficult to get new financing on a vacant building, even if rent is still being paid, because it is clear that when the lease is up the tenant will not renew. As a result, the building owner, Korea Investment Management Co., ran into financial problems on the property which went into foreclosure.

Special servicer Rialto Capital Management has been handling the day-to-day care of the building in recent years. Neither Rialto nor GSK immediately replied to requests for comment.

Office space in the Navy Yard is in high demand, with no official vacancy thanks to GSK’s continued rental of their former space. According to the official website, it hosts over 16,500 workers from 150 companies.

Carpenters union’s plans for the Navy Yard

Plans for the Navy Yard site include constructing a training facility adjacent to the purchased building that would eventually replace the council’s Northeast Philly and New Castle training centers, said Sproule. He estimated that it could cost $30 million to build out “on the low end,” and take at least 24 months to complete.

The move to the Navy Yard will also improve accessibility for some, said Sproule. When apprentices who live in the city are first starting out, they might not have access to a car, he said, adding that the new site is conveniently located near the NRG SEPTA stop.

“I think it’s going to be extremely convenient for members doing journeyman upgrade classes that live within the city limits as well as apprentices that live within the city limits that may not drive as much as folks that live out in the suburbs,” he said.

Sproule said employees of the union could be working out of the Navy Yard site as soon as the end of April, with initially up to 125 people based out of the building’s fourth floor.

The council has also already identified some potential tenants to lease out parts of the Navy Yard building.

Sproule said the council is considering selling the Spring Garden facility, or getting it “zoned for a mid-rise, multifamily structure.”

“We may try to build something similar to what’s across the street, or we may sell it to an interested party. We haven’t made those decisions yet,” he said. “I guess it’s just going to be a matter of what’s more practical and feasible.”

Sproule said the purchase of the Navy Yard site seemed from the start like “a really good deal.” Then when he learned from an article in the Philadelphia Business Journal that the building at one time had sold for roughly $130 million, he said, “knowing that somebody actually invested that kind of capital for that building back then — which wasn’t that long ago, when you think about it — makes me really feel good about our endeavors that we’re about to embark on.”

“Aside from our pension funds and all the investments that we do on that end to make sure that they are strong and secure for generations to come, we do have general fund assets that our Regional Council uses for operational purposes. We just hit a spot in time where we had an opportunity to possibly look at an investment of this size and magnitude, and it was just a matter of being at the right time, at the right place,” he said.

Navy Yard neighbors

The Carpenters are not the first building trades union to move to the Navy Yard from Spring Garden.

In 2023, International Brotherhood of Electrical Workers Local 98 announced that it would be relocating its headquarters from 1719 Spring Garden St. The union purchased two properties for $18.5 million.

“We’re excited to be their neighbors,” said Sproule.

The Regional Council of Carpenters and Local 98 are among the most powerful building trades unions in Philadelphia, and they have strong membership bases in South Jersey and South Philadelphia, making the Navy Yard location at the edge of the city ideal for many members.

The spacious property at the Navy Yard also allows room for training facilities, which could be difficult to co-locate with a headquarters office in other parts of the city.

On the other side of Philadelphia is another concentration of building trades infrastructure in the Far Northeast. Near the Bucks County line, this hub provides similar advantages for union locals that include the Steamfitters, Ironworkers, and Bricklayers.

   "Standing before a judge in Manhattan federal court on Friday, November 19, Michael Forde learned the price of high living and the crime that made it possible: 10 years in prison. For some members of the organization he once headed, the New York District Council of Carpenters and Joiners, that isn’t long enough. Forde had pleaded guilty to racketeering, bribery and perjury in late July in connection with taking as much as $1 million in illegal contractor bribes and skimming many millions more from union benefit funds.

FORMER CARPENTERS’ BENEFIT PLAN ADMINISTRATOR INDICTED ON FRAUD CHARGES

NEWARK, N.J. – The former administrative manager of the United Brotherhood of Carpenters (Carpenters Union) New Jersey/New York benefit funds was indicted today by a federal grand jury for defrauding the funds of more than $1.5 million, U.S. Attorney Craig Carpenito announced.
George R. Laufenberg, 69, of Harvey Cedars, New Jersey, is charged in a five-count indictment with embezzlement of pension funds, embezzlement of deferred compensation payments, embezzlement of excess annuity fund contributions, conspiracy to embezzle with a “low-show” employee, and making a false statement in an annual financial report. He will be arraigned before a U.S. District Court Judge at a later date.

According to the indictment:

Laufenberg is the former administrative manager of the New Jersey Carpenter’s Pension, Annuity, Health and Training/Apprenticeship Funds. He allegedly stole from the benefit plans by using his authority to self-deal and benefit himself with unapproved and improper distributions from pension and annuity funds. He also filed a false U.S. Department of Labor Form 5500 in which he denied he was improperly diverting annuity contributions into his paycheck.

Laufenberg, who earned an annual salary of approximately $300,000, is charged with using his authority to unilaterally grant himself a $120,000 pension and $180,000 in annual deferred compensation, without retiring, or without giving notice or receiving approval from the funds’ board of trustees. He is also charged with diverting into his paycheck monthly annuity contributions, contrary to IRS regulations. Laufenberg also used his authority to grant a personal friend, who was a low-show employee at the funds, a full salary with a pension, annuity contributions and full health care coverage.

The maximum penalty for each count is five years in prison and a $250,000 fine.

U.S. Attorney Carpenito credited the investigators of the Department of Labor (DOL), Employee Benefit Security Administration (EBSA), under the supervision of Darren Cohen, Regional Director; special agents of the DOL Office of the Inspector General (OIG) under the supervision of Special Agent in Charge Michael Mikulka; and the agents of the Port Authority of New York/New Jersey, under the supervision of Inspector General Michael Nestor, with the investigation leading to today’s indictment.

The government is represented by Senior Litigation Counsel V. Grady O’Malley of the U.S. Attorney’s Offices’ Organized Crime/Gangs Unit.

The charges and allegations in the indictment are merely accusations, and the defendant is presumed innocent unless and until proven guilty.

On August 23, 2001, Officer William Leach was on routine patrol in West Richland. He ran a license check on an unoccupied vehicle parked outside a house with a history of drug activity. He learned that the vehicle had been sold in April but the title had not been transferred as required by RCW 46.12.101(6). An hour later, Officer Leach noticed the vehicle being driven. Officer Leach had not been following the car. He pulled it over to investigate the failure to transfer title within 45 days of purchase, a misdemeanor.1

The driver and sole occupant was ....... He gave a false name but eventually identified himself. Officer Leach ran a warrants check and found that Mr had outstanding felony warrants and was driving with a suspended license. The West Richland Municipal Code mandates impoundment of any vehicle being driven by a person under the influence or with a suspended license. Accordingly, Officer Leach ordered the car towed and impounded.

Officer Leach arrested Mr..... on the warrants and for driving with a suspended license. The passenger compartment of the vehicle was searched incident to the arrest. On the front seat, Officer Leach found a laboratory flask and a glass smoking pipe. Both field tested positive for methamphetamine. The flask is of a type Officer Leach recognized as commonly used in manufacturing methamphetamine.

Two acquaintances of Mr..... arrived at the scene. One wanted the vehicle released. Officer Leach explained the procedure generally and that the earliest release would be the next morning. The woman tried to recover the vehicle from the tow truck company by falsely claiming that Officer Leach had authorized the release. Officer Leach put a watch on the car and obtained a search warrant. The affidavit in support of the search warrant cited Mr.... previous drug convictions, the drug-related items on the front seat, and the conspicuous efforts of the woman to obtain release of the car.

Police opened the locked trunk and found three prepackaged baggies of methamphetamine (21.9, 18.6, and 3.3 grams) and scales, along with several guns, one of which was stolen, and an auto repair shop bill with Mr..... name on it.
