The Defendants’ inflexibility is unquestionably based upon Defendants’ hope that the Plaintiff will assert his Fifth Amendment Privilege, in the face of a pending criminal Indictment, to presumably then pave the way for the Defendants to then immediately pursue summary judgment based upon the adverse inference from Plaintiff’s necessarily asserted invocation of his Fifth Amendment Right to Remain Silent and further precluding the Plaintiff’s rights to proceed with deposition discovery"
